This Distance Sales Agreement ("Agreement") is concluded between the Seller, whose information is provided above and who offers services through the website www.guideturco.com, and the Buyer, who purchases services through the website ("Buyer"), upon the Buyer's electronic approval.

2. Subject of the Agreement

The subject of this Agreement is the sale and fulfillment of private tours, customized travel planning, yacht tours, and airport/city transfer services ("Services") ordered by the Buyer through the Seller's website in an electronic environment, as well as the determination of the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers No. 6502 and the Regulation on Distance Contracts.

3. General Information About the Service

The type, scope, date, time, number of participants, and total price of the Service are communicated to the Buyer electronically (via email or the website) during order confirmation and are an integral part of the order summary.

4. Payment

The service fee is collected online via credit card (including 3D Secure-enabled debit cards) through the Seller's secure payment infrastructure (Garanti BBVA Virtual POS). Card details are not stored on the Seller's servers.

5. Fulfillment of the Service

The Service is fulfilled by the Seller or its authorized business partners at the date, time, and meeting point specified in the order confirmation. For airport transfers, the service begins when the vehicle arrives at the specified location.

6. Right of Withdrawal and Cancellation Terms

The absence of a right of withdrawal does not mean that the cancellation and refund policy stated below will not apply. The right of withdrawal and the cancellation/refund policy are two separate, complementary rights.

Since the Services fall under "leisure services to be performed at a specific date and time," the Buyer does not have a right of withdrawal in accordance with Article 15(1)(g) of the Regulation on Distance Contracts. Instead, the Seller applies the following cancellation and refund policy:

A. Cancellation Terms for General Tours and Airport Transfers:

  • For cancellations made 48 hours or more before the service time, the full payment is refunded.

  • For cancellations made 24-48 hours before the service time, 50% of the payment is refunded.

  • For cancellations made less than 24 hours before the service time or in case of no-show, no refund is provided.

B. Cancellation Terms for Private Yacht Tours and Boat Rentals:

For yacht tours and private boat rental services, operational preparations (boat reservation, crew, and logistics) are completed in advance, so the following rules apply instead of the general cancellation terms:

  • For cancellations made 14 days or more before the service date, the full payment is refunded.

  • For cancellations made 7 to 14 days before the service date, 50% of the amount is refunded.

  • No refunds will be issued for cancellations made less than 7 days before the service date or for "no-show" situations.

Cancellation requests must be communicated to the Seller via email or official communication channels.

7. Change Requests

Change requests, such as flight route adjustments, time delays, or itinerary updates, can be made free of charge up to 12 hours before the service time, subject to availability.

8. Refund Procedures

Approved refunds will be transferred to the original card used for payment through the Garanti BBVA Virtual POS infrastructure. The refund amount will typically appear in the account within 7-14 business days, depending on the bank's processing time.

For payments made in foreign currencies (USD/EUR/GBP, etc.), refunds are calculated based on the exchange rate on the date the refund is processed. Any differences arising from exchange rate fluctuations are not the responsibility of the Seller.

9. Dispute Resolution

In case of disputes arising from this Agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of transaction shall have jurisdiction within the monetary limits determined annually by the Ministry of Trade.

10. Effective Date

The Buyer shall be deemed to have accepted all terms of this Agreement electronically at the time of order confirmation, and the Agreement shall become effective immediately upon such confirmation.
